1. Agreement to these terms
These Terms of Service ("Terms") govern access to and use of iRespond's website, AI agents, automation workflows, and client dashboard (together, the "Service"). By using the Service, you agree to these Terms on behalf of yourself and the business you represent.
2. What the Service does
iRespond builds and operates tailored AI agents that reply to customer messages, capture leads, handle bookings, assist with orders, and hand off conversations to your team — based on information and rules you approve. The Service also includes automation workflows and a dashboard for tracking usage, conversations, and billing.
3. Accounts and access
You're responsible for the accuracy of the business information you provide and for keeping your dashboard login credentials secure. You're also responsible for reviewing and approving the information your AI agent is allowed to use — the agent replies only from what you've approved.
4. Plans, billing & usage
Paid plans are billed monthly in advance and include a set allowance of AI replies, with additional usage billed per extra block as described on our Packages page. Fees are non-refundable except where required by law. If payment fails or lapses, we may pause your agent until the account is brought current.
You can cancel at any time; cancellation takes effect at the end of the current billing cycle, and no further payments will be charged after that.
5. Acceptable use
You agree not to use the Service to send spam, deceive customers, impersonate another person or business, or engage in unlawful, abusive, or harmful activity. You're responsible for making sure the information you approve for your agent is accurate and that your use of the Service complies with applicable law, including any rules of the messaging channels you connect (e.g. WhatsApp Business).
6. AI agent limitations
Your agent is trained to answer only from the information and rules you approve, and to hand off to a human when a conversation falls outside that scope. That said, we don't guarantee the agent will be error-free, available without interruption, or a substitute for human judgment in every situation. You remain responsible for how your business ultimately responds to your customers.
7. Third-party channels & tools
The Service connects to third-party platforms you choose — messaging channels, calendars, storefronts, and automation tools such as n8n. We aren't responsible for outages, policy changes, or issues that originate on those third-party platforms, though we'll do our best to help you adapt when they happen.
8. Data & content ownership
You own your business data and the conversations your AI agent has with your customers. We process that data only to provide the Service to you, as described in our Privacy Policy — we don't sell it or use it to train models for other businesses.
9. Termination
Either party may terminate this agreement at any time. On termination, your access to the dashboard and agents ends; on request, we'll provide a reasonable window to export your business data before it's deleted from our systems.
10. Limitation of liability
The Service is provided "as is," without warranty of uninterrupted or error-free operation. To the extent permitted by law, our total liability for any claim arising from the Service is limited to the fees you paid in the three months before the claim, and we aren't liable for indirect, incidental, or consequential damages.
11. Changes to these terms
We may update these Terms from time to time; the "Last updated" date below will reflect the most recent change. Continuing to use the Service after an update means you accept the revised Terms.
12. Governing law
These Terms are governed by the laws of the jurisdiction in which iRespond is registered to operate, without regard to conflict-of-law principles.
